These Terms of Service ("Terms") govern your use of the HushDM mobile application (the "App"), provided by GTech Group ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The service
HushDM is an on-device photo vault and private messaging app for iPhone and iPad. It provides password-protected storage for photos, videos, and messages, optional end-to-end encrypted sharing with other HushDM users, and optional encrypted iCloud backup.
2. Your account and security
- You are responsible for keeping your passcode and recovery key safe. Because vault content is encrypted on your device, we cannot recover it if you lose your credentials.
- You must be at least 13 years old (or the minimum age required in your country) to use HushDM. If you are under 18, you must have permission from a parent or guardian.
- You agree to provide accurate information when you create an account and to keep it up to date.
3. Subscriptions and payments
- HushDM offers a free tier and a Premium subscription. Premium features are unlocked for the duration of an active subscription.
- Subscriptions are billed through your Apple ID. A 7-day free trial may be offered to first-time subscribers; if offered, it will automatically convert to a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends.
- Subscriptions renew automatically at the price and interval shown at the time of purchase until you cancel. You can manage and cancel your subscription in your Apple ID settings. Deleting the app does not cancel your subscription.
- Refunds for App Store purchases are handled by Apple under Apple's Media Services Terms.
4. Acceptable use
You agree not to use HushDM to:
- Store, share, or transmit content that is unlawful — including, but not limited to, child sexual abuse material, content that depicts sexual exploitation of minors, or content that infringes another person's rights;
- Harass, threaten, or harm another person, or to facilitate such conduct;
- Reverse-engineer, decompile, or attempt to extract the source code of the App except to the extent permitted by law;
- Interfere with the operation of the App, probe or scan for vulnerabilities, or attempt to gain unauthorized access to any account or system.
We may suspend or terminate accounts that violate these rules. Because we cannot read your vault, we rely on user reports and metadata (for example, sharing patterns) to enforce acceptable-use rules for the messaging component.
5. Your content
You keep all rights to the photos, videos, and messages you store in HushDM. You grant us only the minimum license needed to operate the App on your behalf (for example, to route encrypted messages between devices or to back up your encrypted vault to your iCloud container). We do not claim ownership over your content and we do not use it to train models or sell to third parties.
6. Intellectual property
The App, its design, logos, and source code are owned by us or our licensors and are protected by copyright, trademark, and other laws. These Terms do not grant you rights to our trademarks or to redistribute the App.
7. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that any stored content will be preserved. Always keep an independent backup of anything you cannot afford to lose.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the App. Our aggregate liability for any claim relating to the App is limited to the amounts you paid us for the App in the 12 months before the claim.
9. Termination
You may stop using the App at any time by deleting it from your device and deleting your account from Settings. We may suspend or terminate your access to the App if you violate these Terms or if we are required to do so by law. Sections that by their nature should survive termination (for example, ownership, disclaimers, and limitation of liability) will survive.
10. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in-app. Your continued use of the App after changes take effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which GTech Group is established, without regard to its conflict-of-laws rules. If you are a consumer, mandatory consumer-protection laws in your country of residence still apply.
