These Terms of Service ("Terms") govern your use of the HushDM mobile application (the "App"), provided by Global Tech Operations LLC ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The service
HushDM is an on-device photo vault and private messaging app for iPhone and iPad. It provides password-protected storage for photos, videos, and messages, optional end-to-end encrypted sharing with other HushDM users, and optional encrypted iCloud backup.
2. Your account and security
- You are responsible for keeping your passcode and recovery key safe. Because vault content is encrypted on your device, we cannot recover it if you lose your credentials.
- You must be at least 13 years old (or the minimum age required in your country) to use HushDM. If you are under 18, you must have permission from a parent or guardian.
- You agree to provide accurate information when you create an account and to keep it up to date.
3. Subscriptions and payments
- HushDM offers a free tier and a Premium subscription. Premium features are unlocked for the duration of an active subscription.
- Subscriptions are billed through your Apple ID. A 7-day free trial may be offered to first-time subscribers; if offered, it will automatically convert to a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends.
- Subscriptions renew automatically at the price and interval shown at the time of purchase until you cancel. You can manage and cancel your subscription in your Apple ID settings. Deleting the app does not cancel your subscription.
- Refunds for App Store purchases are handled by Apple under Apple's Media Services Terms.
4. Acceptable use and zero-tolerance policy
HushDM has zero tolerance for objectionable content and abusive behavior. You agree not to use HushDM to create, store, share, transmit, or otherwise make available any content that:
- Depicts, describes, or promotes the sexual exploitation or abuse of a minor, including any form of child sexual abuse material (CSAM).
- Is pornographic, sexually explicit, or otherwise obscene when the recipient has not consented to receive it, or when sent to a minor.
- Harasses, bullies, threatens, stalks, defames, or incites violence against another person or group, or facilitates such conduct.
- Promotes terrorism, organized criminal activity, or illegal weapons or drug sales.
- Infringes another person's intellectual-property, publicity, or privacy rights (for example, non-consensual intimate imagery).
- Contains malware, phishing links, or is intended to defraud, impersonate, or deceive another HushDM user.
- Attempts to reverse-engineer, decompile, or extract the source code of the App except to the extent permitted by law; or interferes with the App's operation, probes for vulnerabilities, or gains unauthorized access to any account, system, or another user's data.
You are solely responsible for the content you send through HushDM. We may suspend or permanently terminate accounts that violate these rules and, where required by law, report the offending material to the appropriate authorities (including, for content involving minors, the National Center for Missing & Exploited Children).
5. Reporting abuse and moderation
Because chat messages are end-to-end encrypted, HushDM cannot read them on its own. Moderation therefore depends on the tools we build into the App and on reports from users:
- Block. You may block any user at any time from the chat or contact-info screens. A blocked user cannot send you messages or open a conversation with you.
- Report. You may report any message by long-pressing it and choosing Report. The App uploads your local copy of the message along with a category (spam, harassment, sexual content, violence, child sexual abuse, or other) to our moderation inbox.
- Muted words. You may maintain a personal keyword filter in Settings → Safety to hide incoming messages matching keywords you choose. This filter runs on-device.
We review every report within 24 hours and take action — including account termination — against users who violate this Section 4. By using HushDM you acknowledge and agree to this 24-hour review commitment and to our zero-tolerance policy for objectionable content and abusive users.
6. Your content
You keep all rights to the photos, videos, and messages you store in HushDM. You grant us only the minimum license needed to operate the App on your behalf (for example, to route encrypted messages between devices or to back up your encrypted vault to your iCloud container). We do not claim ownership over your content and we do not use it to train models or sell to third parties.
7. Intellectual property
The App, its design, logos, and source code are owned by us or our licensors and are protected by copyright, trademark, and other laws. These Terms do not grant you rights to our trademarks or to redistribute the App.
8. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that any stored content will be preserved. Always keep an independent backup of anything you cannot afford to lose.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the App. Our aggregate liability for any claim relating to the App is limited to the amounts you paid us for the App in the 12 months before the claim.
10. Termination
You may stop using the App at any time by deleting it from your device and deleting your account from Settings. We may suspend or terminate your access to the App if you violate these Terms or if we are required to do so by law. Sections that by their nature should survive termination (for example, ownership, disclaimers, and limitation of liability) will survive.
11. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in-app. Your continued use of the App after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which Global Tech Operations LLC is established, without regard to its conflict-of-laws rules. If you are a consumer, mandatory consumer-protection laws in your country of residence still apply.
